Terms of Service for SWEAT

Welcome to SWEAT! These Terms of Service ("Terms") govern your use of our mobile application and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing and using the Service, you represent that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years old to create an account on SWEAT. By creating an account, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into this agreement.

3. Your Account and Profile

You are responsible for maintaining the confidentiality of your login credentials. You are also responsible for all activities that occur under your account. You agree to provide accurate and truthful information in your profile and to update it as necessary. You may not use a third party's account or share your account with anyone else.

4. User Conduct and Content

You agree to use the Service in a manner consistent with all applicable laws and regulations. You are solely responsible for all content that you upload, post, transmit, or otherwise make available on the Service ("User Content"). You agree not to post, send, or share any User Content that:

• Is illegal, obscene, pornographic, defamatory, threatening, or harassing
• Infringes upon the rights of any third party, including intellectual property rights or privacy rights
• Contains personal information of a third party without their consent
• Promotes racism, hatred, or physical harm of any kind against any group or individual
• Is spam, misleading, or fraudulent
• Contains viruses or other harmful computer code
• Uses the Service for any commercial purposes without our permission
• Attempts to gain unauthorized access to the Service or other users' accounts
• Impersonates any person or entity

SWEAT reserves the right, but has no obligation, to review and remove any User Content that violates these Terms or is otherwise objectionable.

5. Intellectual Property Rights

Your Content:

You retain all rights to your User Content. By posting User Content, you grant SWEAT a worldwide, royalty-free, perpetual, and irrevocable license to use, copy, modify, display, and distribute your User Content in connection with the Service and our business.

SWEAT's Content:

All intellectual property rights in the Service itself, including but not limited to text, graphics, logos, and software, are owned by or licensed to SWEAT. You may not use or reproduce this content without our express written permission.

6. Third Party Fitness App Integration

By connecting your third party fitness application account, you authorize us to access and display your activity data. You can disconnect third party account at any time through the app settings.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

8. Safety and User Interactions

You are solely responsible for your interactions with other users of the Service, both on and off the platform. You understand that SWEAT does not conduct background checks or inquiries into the backgrounds of its users. SWEAT makes no representations or warranties as to the conduct or compatibility of users. You agree to take reasonable precautions in all interactions with other users, especially if you decide to meet in person. We recommend meeting in public places and taking appropriate safety precautions.

9. Subscription and Payments

Some features of the Service may require payment. By subscribing, you agree to pay all applicable fees. Subscriptions automatically renew unless cancelled. Refunds are subject to our refund policy and applicable app store policies.

10. Disclaimers and Limitation of Liability

The Service is provided on an "as-is" and "as-available" basis. SWEAT makes no warranties or representations regarding the accuracy, completeness, or reliability of any content or the Service itself. We do not guarantee that the Service will be error-free or uninterrupted. We are not responsible for the conduct of any users on or off the Service.

TO THE FULLEST EXTENT PERMITTED BY LAW, SWEAT AND ITS AFFILIATES, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account at any time, for any reason, without notice. Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time by following the instructions in the app.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.

15. Changes to these Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms in the Service. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.
